A rescisão (termination under Brazilian CLT labor law) entitles the employee to several items depending on the termination type: saldo de salário (the final worked days), aviso prévio (notice period, 30 days plus 3 days per full year of service, capped at 90 days), prorated vacation pay plus its constitutional one-third, and a prorated 13th salary. An employer-initiated dismissal without cause additionally triggers the 40% FGTS penalty; a mutually-agreed termination triggers half of it.

The calculation runs entirely locally in your browser, in pure JavaScript - nothing is uploaded or stored. On a resignation or a for-cause dismissal, the indemnified notice pay and the FGTS penalty both drop to zero; on a mutually-agreed termination both are halved. The FGTS balance used for the penalty is approximated from the full years and prorated months entered, since no real deposit history is available here.

An honest note: this is a model-based estimate, not an official rescisão settlement. The total shown is a gross figure across all items - in a real payroll run, the saldo de salário and the prorated 13th salary are still subject to INSS and IRRF, while the indemnified notice pay and the FGTS penalty are tax-exempt. This difference in tax treatment between the individual items is not modeled here.

In 3 steps

  1. Enter your gross salary and choose the termination type.
  2. Adjust the years of service, prorated months and days worked.
  3. Read off every item and the total.

Limitations: A model-based estimate, not an official rescisão settlement. The total is a gross figure - INSS/IRRF on the saldo de salário and the 13th salary are not deducted, even though the notice pay and FGTS penalty are genuinely tax-exempt. The FGTS balance is an approximation from years and months, not a real account statement. Check the exact amounts with your employer or a professional.

FAQ

Does my salary leave my device?

No, the entire calculation runs locally in your browser - nothing is uploaded or stored.

Do I receive notice pay if I resign myself?

No, indemnified notice pay only applies to an employer-initiated dismissal (full or halved on a mutual agreement) - a resignation receives none.

When does the 40% FGTS penalty apply?

Only on an employer-initiated dismissal without cause; a mutually-agreed termination pays half, and a resignation or for-cause dismissal pays none.

How are the prorated months determined?

Enter the months since the last full 12-month cycle - a month with at least 15 days worked counts as a full month.

Are INSS and IRRF included in the total?

No, the total is a gross figure across all items - see the limitations for the different tax treatment of each item.
