Gratuity is a statutory lump-sum payment under the Payment of Gratuity Act, 1972, that an employer pays when an employee leaves the organisation - usually after at least five years of continuous service. The formula is: 15 days' salary (Basic plus Dearness Allowance) per completed year of service, computed as 15 times salary times years of service divided by 26 - the 26 divisor comes from the daily wage itself being computed as the monthly salary divided by 26 working days. Establishments not covered by the Act often use a 30-day divisor instead.
